Goods Display Permit

According to the Trading in Public Places Local Law 2008, goods means any  good involved in the contravention that can lead to impounding, and includes - (b) a stall or other structure temporarily placed on land, involved in such as contravention.

A goods display permit allows you to display goods associated with your approved business on the footpath area in front of your premises and you may extend this goods display in front of the adjacent tenanted business, if you have obtained permission from the owner of the business. You may also extend the goods display in front of an adjacent vacant business, if you have obtained permission from the owner of the tenancy.

Before you start your application, there are a few requirements you need to be aware of, including:

  • You will need public liability insurance with a minimum of $10 million coverage that specifically includes using the footpath for this type of activity;
  • Goods displays located on the footpath must be located either within the frontage or kerbside zone (see Fig 1. below);
  • Goods displays associated with a COVID-19 Temporary Parklet must adhere to the COVID-19 Temporary Parklet Guidelines;
  • A minimum 1500mm continuous clear pathway for pedestrians;
  • Frontage zone only if the speed limit on your road is 60km/per hour or more, if your business is on Charles Street and/or you are located within 10 metres of a corner);
  • The goods display must be removed from the footpath at close of business each day;
  • Ensure that the goods are of a stable design and is not readily moved by the wind, and does not cause any hazard or danger to any person using the thoroughfare;
  • Only display goods on a footpath which immediately abuts and not extending more than 1 metre from the building, which is occupied by the owner of the goods or in a location approved by the local government and specified in the permit;
  • Ensure the free passage of persons using the footpath is maintained at all times; and
  • A person shall not cause or permit goods to be displayed in such a condition, which in the opinion of an authorised person, causes or is likely to cause injury or danger to any person or damage to the clothing or possessions of any person.

To submit your online application, you will need to upload the following information:

  • An accurate plan and description of:
    • The proposed goods; and
    • The proposed location of the goods and the area in a radius of approximately 10 metres around the location on a scale of 1:100 the location of all carriageways, footpaths, verges, street furniture, light poles, parking signs, traffic lights, other impediments to pedestrian traffic and premises abutting any verge or footpath;
  • Colour photograph (or similar) of the proposed goods; and
  • Certificate of Currency for minimum $10 million public liability insurance.

I verify that my public liability insurance policy has a minimum liability limit of $10 million (ten million dollars) and that the policy covers my usual business activities including the provision of an outdoor eating area/display of goods/display of signage on footpaths or other trading places which may or may not be under the ownership, care, custody and control of the City of Vincent.*
I confirm that valid planning approval is held (where required) for the land use associated with this permit.*
I declare that I am the legal occupant of the property detailed in this application and that I am duly authorised to make this application on behalf of the business’*
I am aware of all of the requirements and obligations under the Trading in Public Places Local Law 2008/Local Government Property Local Law 2021 and agree to comply with these.*
I agree to indemnify the City in respect of any injury of any person or any damage to any property which may occur in connection with my use of the public place as an outdoor eating area.*
Within the past 5 years, I nor the business for which this permit is being sought, have been committed of a breach of any provisions of the Trading in Public Places Local Law 2008*
I, nor the business for which this permit is being sought, are an undischarged bankrupt or in liquidation.*
I, nor the business for which the permit is being sought, have entered into any composition or arrangement with creditors.*
I, nor the business for which the permit is being applied for, have appointed a manager, administrator, trustee, a receiver or a receiver and manger in relation to any part of my person, or the business for which the permit is being applied for, undertakings or property.*
I confirm that there are currently no trading activities occurring in the public space the subject of this application (if this application is to renew a permit, this is aside from the activity the subject of this application).*

Please include the following in the plan and description of the Goods Display:

  • The proposed goods/signage;
  • The proposed location of the signage and the area in a radius of approximately 10 metres around that location showing on a scale of approximately 1:100 the location of all carriageways, footpaths, verges, street furniture, bins, light poles, parking signs, traffic lights, other impediments to pedestrian traffic and premises abutting any verge or footpath; and
  • Provide a colour photograph or similar representation of the goods/sign (compulsory).

The permit holder shall:

  • Maintain the goods display in a safe condition at all times;
  • Display the permit number provided in a conspicuous location near the goods display and product their permit when requested by an authorised person from the City;
  • Ensure the goods display and goods are of a stable design, cannot be readily moved by wind and do not cause hazard or danger to any person using the footpath;
  • Ensure free passage of persons using the footpath;
  • Maintain a minimum 1500mm clear pedestrian zone which is clear of any structures including bins, signs and the like. The clear pedestrian zone must align with the clear pedestrian zone in front of neighbouring properties to ensure pedestrians have a clear and uninterrupted access along the footpath;
  • Maintain a minimum 600mm kerb buffer between the kerb and start of the kerbside zone;
  • Maintain uniformity in sections of streets to ensure clear pedestrian access and aesthetic appeal;
  • Maintain public liability insurance with a minimum $10 million liability through a reputable insurance company for the duration of the permit.

Goods Display specifications

  • Pot plant containers should be a minimum height of 600mm, a maximum height of 750mm, a maximum length of 1000mm and a minimum width of 350mm. Pot plants in the frontage zone should abut the building;
  • Goods displays shall have a minimum height of 500mm;
  • Displays in the frontage zone must abut the building and the outer face of the goods display may extent up to 1000mm from the building.

Foodstuffs and hazardous materials are not permitted.
