Have you just signed a lease? Are you intending to refurbish the commercial premises? Is a building permit required?

There is a common misconception that if a fit-out is non-structural in nature or the building cost is less than $20,000, a Building Permit is not required. That is incorrect.

A Building Permit must be obtained if your fit-out work includes installation of:

  • Electrical outlets and lighting
  • Floors and ceilings
  • HVAC systems
  • Fire protection systems
  • Toilets
  • Partitions
  • Cool rooms

Building Permit requirements for fit-out work apply to both new and existing commercial buildings.

Some of the reasons why a Building Permit is needed for a fit-out include:

  • Partitions can affect occupant egress to an exit during evacuation in a fire emergency.
  • The layout of the premises may affect access to and within the building by a person with a disability. Most buildings are required by law to provide access for people with disabilities.
  • HVAC systems and fire protection systems including exit signs have to comply with relevant Australian Standards and the Building Code of Australia.
