Public Buildings

A “public building” is defined as a place where members of the public usually or occasionally assemble. The assembly must be a more formal than fortuitous collection of people.  The assembly must also be the result of all members acting in concert and by some pre-arrangement having the common intention of congregating at the same time or for the same period, more or less.

Environmental Health Officers are responsible for the approval and regular assessment of all public buildings in conjunction with relevant agencies. Public buildings are assessed on their type of use, maximum number of persons permitted at any one time, and public safety. With this in mind, an open air concert, cinema, church and a nightclub will be subject to some of the same regulatory requirements.

Where public buildings are to be constructed, extended or altered and are subject to a normal building licence issued under the Local Government Authority, they are to be approved by City of Vincent Building Services under the Building Code of Australia (BCA) and must comply with the requirements of the Health (Public Buildings) Regulations 1992.

Should you be considering opening a Public Building, please contact the Planning & Building Services (9273 6000 or mail@vincent.wa.gov.au) to ensure you have the right approvals.
